Terms of Service - Skype Premium Calls
These Terms of Service for Skype Premium Call (Beta) (the “TSSP”) are additional to Skype’s End User License Agreement (the “EULA”), Terms of Service (the “TOS”) and Privacy Statement. The TSSP lays out the specific terms for an additional product accessible through Skype Software, as defined below. By accepting this TSSP You further confirm Your acceptance of the EULA, TOS and Privacy Statement (the “Agreements”), and understand that all terms in such Agreements shall apply also to this TSSP. You must be 18 years old or older to use Skype Premium Call (Beta).
Definition of Skype Premium Call (Beta) and Content. Skype Premium Call (Beta) is a feature of Skype Software, enabling You to call over Skype Software to a designated Skype user ID to access third party content, against a charge (“Skype Premium Call (Beta)”). Such third party content can consist of information services, helplines, entertainment, competitions and other types of content that Skype may at its discretion make available to You from time to time (the “Content”).
Using Skype Premium Call (Beta). To use Skype Premium Call (Beta) and access the Content You will make a Skype Software call from Your User Account to a designated Skype user ID where Content is being provided. The call will start as a free Skype Software call. During the call the third party providing the Content shall indicate to You the price of the Content, before the call becomes chargeable. To continue the call, You need to opt to pay for the Content by clicking the ‘accept’ button otherwise the call will terminate.
Payment and Refunds. To use Skype Premium Call (Beta) and pay for the Content You need a positive and sufficient Skype Credit balance prior to the start of the call. Skype Credit can be purchased, paid for and refunded in accordance to the terms applicable to any Skype product. See the TOS for details.
Charges for Skype Premium Call (Beta). Charges for Skype Premium Call (Beta) could be a rate-per-minute or a per-call fee. Please note that the rate-per-minute is different from the SkypeOut calling rates and You will need to accept the applicable rate on a case by case basis, before accessing the Content. Such rates are determined by the third party service provider and are subject to change at all times (except during the call). The rate does not include 15% VAT that may be applicable if you’re resident in the EU, and that You already have paid upon purchase of your credit (if applicable). The duration of the Skype Premium Call (Beta) call shall be based on one-minute increments. Fractions of minutes will be rounded up to the next minute after five seconds.
Free Calling and Fixed Price Plans not Applicable. Please note that Skype Premium Call (Beta) is not included in any fixed price or free calling plans or any other marketing promotion (unless explicitly included).
Support for Skype Premium Call (Beta). If You encounter any problems related to payment, pricing or use of Skype Premium Call (Beta), please contact support@skype.com. Skype provide support only in the following languages: English, German, French, Spanish, Italian, Japanese. In the event You believe that Skype has charged You in error or for any claim related to the Content, You must contact the support within 14 days after such charge. No refunds will be given for any charges which are more than 14 days old.
No Use by Third Parties. Your license to use Skype Software and, consequently, to Skype Premium Call (Beta) is for personal use only. Please note that Skype does not offer a call barring functionality enabling You to block Skype Premium Call (Beta). Therefore it is important that You do not allow third parties to access Your User Account, and that You keep Your Password separate from the User ID and not reveal it to any third party. You shall be fully responsible for any activities carried out through Your User Account, including any unauthorized use by any third party of such account, and Skype shall not be held responsible for any such use. You agree to defend, indemnify, and hold harmless Skype, Skype employees and affiliates from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, attorneys fees) arising from Your failure to prevent anyone from using Your Skype account.
No Warranties for Content. All Content is provided ‘as is’ and by third party companies, and no express, implied or statutory warranties apply to Content, including without limitation warranties of quality, performance, non-infringement, merchantability or fitness for a use or a particular purpose.
Special Disclaimer of Skype Liability for Content. You acknowledge that Skype does not control, monitor or have knowledge of any part of the Content You can access through Skype Software. The Content is entirely the responsibility of the third party service provider from whom it originates. That means it is possible that You are exposed to content that is offensive, illegal, harmful to minors, indecent or otherwise objectionable. Skype, its officers or employees may not be held liable for any claim, damage, or loss related to the Content and You hereby waive, to the maximum extent permitted by applicable law, any and all claims or causes of action towards Skype, arising from or relating to the Content.
Restrictions of Use. If You have a reason to believe that the law of Your country prohibits You to access the Content because You’re under the age limit or just because the Content is not allowed in Your country, please don’t use Skype Premium Call (Beta).
Termination. Skype may suspend or terminate Your access to Your User Account, with immediate effect, if we think that You are in breach of this TSSP. Further rights of termination are defined in the TOS and EULA.
